ЮРИДИЧНІ ЗАСАДИ ВИКОРИСТАННЯ АГРОДРОНІВ У ПЕРІОД ДІЇ ВОЄННОГО СТАНУ В УКРАЇНІ

У статті проаналізовано юридичні засади використання агродронів в Україні в умовах воєнного стану. Досліджено основні акти законодавства, якими регулюється використання безпілотників у цивільній авіації України. Відповідно до Повітряного кодексу України дрони належать до безпілотних повітряних суден, що експлуатуються або розроблені для експлуатації автономно чи які пілотуються дистанційно без пілота на борту. У дослідженні з’ясовано стан нормативного забезпечення у сфері цивільних безпілотних повітряних суден (БПС) та здійснено огляд законопроєктів, що стосуються вдосконалення чинної регламентації даної галузі. Зокрема увагу приділено проєкту Закону України № 3716 від 22.06.2020, що включений 10.02.2025 до порядку денного сесії Парламенту. Окремою частиною наукової роботи є аналіз особливостей механізму отримання дозволів для запуску агродронів в умовах воєнного стану в Україні на прикладі рішення Ради оборони Чернівецької області від 12.08.2022. У статті зроблено огляд актів Європейського Союзу – Регламентів ЄС № 2019/947 від 24.05.2019 про правила та процедури експлуатації безпілотних літальних апаратів та № 2019/945 від 12.03.2019 про безпілотні авіаційні системи та операторів безпілотних літальних систем третіх країн. Досліджено найновіший досвід Польщі щодо цифровізації послуг з експлуатації цивільних дронів на єдиному порталі Національної інформаційної системи безпілотників, що офіційно стартував 04.04.2024. Запропоновано практичні рекомендації для вдосконалення нормативно-правового регулювання у сфері використання цивільних БПC в Україні.
